On October 17, California’s Fourth District Court of Appeal reinstated the 30-foot height limit within San Diego’s Midway District planning area. The decision overturns Chamber-endorsed Measure C, adopted by San Diego voters in 2022.
The ramifications of this ruling for San Diego and the Midway District are still being assessed, but the
team behind the proposed redevelopment of San Diego’s iconic Sports Arena property says its Midway Rising project is still moving forward full steam ahead.
Midway Rising, which is strongly supported by the Chamber and numerous other organizations, is poised to make affordable housing history in California, with 2,000 units planned for San Diegans most in need. As such, the development team intends to utilize various state laws, including density bonus law, to advance the project as scheduled despite the appellate court ruling.
Midway Rising remains confident in its ability to create a neighborhood-defining project and will continue to press forward to final City Council approval hearings before the end of the year. The Chamber will continue to analyze the broader impacts of this ruling and will keep our membership informed as we learn more.
